1. Purpose and parties
This agreement is entered into between the contracting entity identified above (“the Company”, “we” or “1Kamas”) and any person who offers us kamas through the site (“the Supplier” or “you”).
It sets out the terms on which the Company buys kamas, the virtual currency of the games Dofus 3, Dofus Retro, Dofus Touch and Wakfu, for resale.
It applies in addition to our Terms and Conditions, which continue to govern the use of the site and your account. In the event of any conflict between this agreement and those Terms in relation to a sale of kamas to the Company, this agreement prevails.
2. Who can sell
Selling kamas to the Company is restricted to persons aged 18 or over. We may refuse a request or a payment where this condition is clearly not met.
You undertake to provide accurate information and to keep it up to date, in particular your contact and payment details. Any request submitted from your account or with your details is deemed to have been made by you.
We will never ask for your password or for access to your game account.
3. Transactions covered
This agreement covers the purchase, for payment, of kamas that you hand over to us in game.
There are two ways to sell. You can submit a request from the Sell Kamas page: we check your request and get back to you. You can also use our dedicated supplier platform, which shows the daily price and has its own terms. In both cases, the rules on ownership, origin and liability set out in Article 6 apply.
4. How a request works
Each request follows three steps. You describe your offer: game, server, quantity, character name and contact method. We check the request and get back to you within 24 working hours using the contact method you provided. A delivery agent then arranges to meet you in game and reminds you of your request number, and payment is made once the delivery has been verified.
This describes a standard transaction. Where a request contains unusual elements, or where the goods offered show signs of a suspicious origin, payment is not released immediately: the request is placed under manual review and is only settled once that review is complete. You will be informed of this through the contact method given in your request.
5. Price and payment
The price is agreed with you when your request is confirmed, based on the game, the server, the quantity offered and market conditions at the time of confirmation. It is guaranteed for the period stated in that confirmation. After that period, or if the market changes significantly before the hand-over, a new price is offered to you before the hand-over and you remain free to refuse it and cancel the request at no cost.
Payment is only triggered once receipt of the kamas has been verified, using the method agreed when the request was made.
The payment details you provide must belong to you; we reserve the right to request supporting evidence if in doubt. We do not make any payment to a third party: the payment account must be in the Supplier's name. For settlement in cryptocurrency or stablecoin, the receiving wallet must be under your sole control, and we may ask you to prove this before making the settlement.
6. Ownership, origin of goods and Supplier liability
By offering kamas, you warrant:
- that you are their legitimate owner or have the right to transfer them;
- that these goods were legitimately acquired;
- that they do not originate from theft, an account that was compromised, hacked or used without authorisation, unauthorised access, fraud or scams, a stolen, fraudulent or abusively disputed payment method, a fraudulent chargeback, duplication or cloning, the abusive exploitation of a flaw, the use of automated tools or bots, or any other illegal or prohibited activity;
- that the proof of delivery, screenshots and transaction information you provide are not falsified;
- that the payment details you provide belong to you.
You are responsible for the accuracy of this warranty. Where it becomes apparent, before or after the transaction, that it has not been complied with, we may refuse the transaction, defer or withhold payment, review your previous transactions, restrict or block your access to the services, and exercise the applicable contractual remedies. You are liable for the direct consequences of an inaccurate declaration, including the repayment of any sums received for goods whose origin proves to be illegitimate.
These provisions do not affect the rights you enjoy as a consumer under the mandatory provisions applicable to you.
7. Declaration collected with each request
Before sending your request, you must confirm the declaration of ownership and origin, which sets out the warranties in Article 6. This acceptance is recorded with your request, together with its date and time and the version of the policies then in force, along with a request number that is given to you. Each transaction can therefore be linked to the exact terms you accepted.
8. Verification
For each transaction, we keep the information needed to verify it: request number, game, server, character, quantity, amount, payment method, delivery date and status, as well as your acceptance of the declaration and its date. Where a transaction presents a risk factor, for example an unusual quantity, inconsistent information, a previous incident or a sudden change in activity, it may be placed under enhanced verification. You may then be asked for explanations of the origin of the goods, screenshots or confirmation that the payment account belongs to you before acceptance or payment. Payment may be deferred for as long as is reasonably necessary for this review.
The checks applied are described in our Supplier Verification Policy.
9. Manual review and duty to cooperate
Where a request is placed under manual review, you are required to cooperate and to provide, within a reasonable time, the information and supporting documents we request regarding the ownership and origin of the goods.
This may include an explanation of how the goods were obtained, screenshots or a recording of the relevant in-game activity, or confirmation that the payment account or wallet belongs to you. Payment remains withheld for the duration of the review.
If you fail to cooperate, or if the evidence provided does not reasonably establish the ownership and legitimate origin of the goods, the request is refused and closed without payment.
Where the review establishes that the goods originate from one of the sources prohibited under Article 6, the transaction is refused, no payment is released, your access to the services is blocked and the business relationship is terminated. The evidence reviewed and the decision are retained and, where the facts so require, we inform the competent authorities, the game publisher or our payment service providers.
10. Consequences of a breach
In the event of a breach of this agreement, and in particular of the warranty given in Article 6, we may, depending on the seriousness of the breach: refuse the request; withhold payment; cancel the transaction; review your previous transactions; restrict or close your access to the services; and claim repayment of any sums already paid for goods whose origin proves to be illegitimate.
Where a sum is owed to us following an inaccurate declaration or a fraudulent transaction, we may set it off against any amount we owe you in respect of another pending transaction, within the limits permitted by the law applicable to you.
These measures apply without prejudice to any other remedy available to us and do not affect the rights you enjoy as a consumer.
11. Cancellation and missed appointments
You may cancel your request at any time before the kamas are handed over, at no cost, by letting us know through the contact method given in your request. If the Supplier does not turn up to the agreed meeting and does not respond within twenty-four hours, the request is closed and may be submitted again.
12. Acceptable use
Our Acceptable Use Policy describes prohibited uses, the sources of goods we refuse and the measures that apply in the event of a breach. It applies in full to this agreement.
13. Personal data
Information collected as part of a request is processed as described in our Privacy Policy, which sets out the categories of data, the purposes, the retention periods and your rights.
14. Changes to this agreement
We may amend this agreement to reflect changes to our services or to the regulations. The agreement that applies to a request is the one published on the site on the day that request is submitted.
15. Governing law and jurisdiction
Where the transaction is concluded with GAMEHUB LIMITED, this agreement is governed by and construed in accordance with the laws of Hong Kong, and disputes fall within the jurisdiction of the courts of Hong Kong. Where it is concluded with Kamasense Limited, it is governed by and construed in accordance with English law, and disputes fall within the jurisdiction of the courts of England and Wales. This clause does not deprive consumers of the mandatory protections they enjoy in their country of residence, which cannot be excluded by contract.
16. Contact
For any question about this agreement, or to report virtual goods you believe to be illegitimate in connection with a transaction, you can write to us via our contact page.
